Terms
The term “Challenge” refers to the Share Your Story Challenge.
The “Challenge Sponsor” is the U.S. Department of State.
The “Entrant” is the owner of the ExchangesConnect account
associated with Challenge participation.
An “Entry” is a successful submission of the webform found on
http://connect.state.gov/page/share-your-story.
Eligibility
Entrants must be members of ExchangesConnect.
Entrants must be 14 years or older at the time of the
submission.
The Challenge is open to individuals of all countries
worldwide.
The Challenge is void where prohibited by law.
The following individuals are not eligible to enter the Challenge:
employees, directors and officers of the Challenge Sponsor, the
U.S. government, Ning, and each of their respective parent,
subsidiary and affiliated companies, as well as contractors of the
U.S. government, distribution, web design, advertising,
fulfillment, judging and Challenge agencies involved in the
administration, development, fulfillment and execution of this
Challenge (collectively, "Challenge Parties"), and the immediate
family members (spouse, parent, child, sibling and spouse or "step"
of each) and those living in the same household of each such
individual.
General Requirements
• Entrants must be members of ExchangesConnect.
• Upon submission of the Entry, the Entrant waives all rights to
modify, alter, or retract his/her Entry.
• Participation is subject to Entrant’s consent to the Challenge
Sponsor’s
Terms of Service and Privacy Policy, as posted
on the
http://connect.state.gov web
site.
Registration
The one individual named as the registered owner of the
ExchangesConnect user account profile associated with the Entry
will be considered the Entrant. If an Entry is developed by several
people working together, the one individual who sends the Entry is
considered the Entrant. If the Entry is selected, the winner is the
one Entrant who entered that submission.
Liabilities and Rights
The Challenge Sponsor does not endorse any Entry or any opinion,
recommendation, or advice expressed therein, and the Challenge
Sponsor expressly disclaims any and all liability in connection
with all Entries.
The Entrant assumes sole responsibility for the material contained
in the Entry and for the consequences of submitting it to the
Challenge Sponsor.
Neither the Challenge Sponsor nor any of the Challenge Parties is
liable for any disputes between collaborators related to an
Entry.
Entrants retain ownership of their Entries. However, by submitting
an Entry to the Challenge, Entrants grant the Challenge Sponsor a
worldwide, non-exclusive, royalty-free, transferable license to
use, reproduce, distribute, prepare derivative works of, display,
and perform the Entries in any media formats and through any media
channels in connection with the Challenge and in connection with
the business of the Challenge Sponsor. Entries are subject to
editing, as they may be used by the Challenge Sponsor for
promotional purposes.
Submitting Entries
Entrants must join the ExchangesConnect community in order to
submit an Entry.
Once Entrants have logged into the ExchangesConnect community, they
should navigate to the “Share Your Story” submission page (
http://connect.state.gov/page/share-your-story),
complete the webform including all required questions, and submit
the webform successfully. For any questions on how to submit an
Entry or problems with the submission process, Entrants may e-mail
the ExchangesConnect Administrator.
Judging Process and Prizes
All Entries will be monitored by the Challenge Sponsor to ensure
compliance with the Terms of Ning, ExchangesConnect, and the Rules
of the Challenge. They will also be evaluated for accuracy by the
Challenge Sponsor. The Challenge Sponsor will make the final
selection of the winners based upon specific criteria (listed
below).
Each Share Your Story selected author will be featured on
ExchangesConnect and will receive an ExchangesConnect T-shirt. The
featured stories will be selected based on:
• Quality and uniqueness of exchange program story
• Willingness to work cooperatively with Challenge Sponsor in
developing and editing the story.
Additionally, there will be a quarterly drawing among all featured
authors for a Flip Video Camcorder. The dates for the drawings will
be announced ahead of time on
http://connect.state.gov. Authors
who have already won a Flip Video Camcorder may not qualify
again.
General Terms and Conditions
If for any reason the Challenge is not capable of running as
planned, including without limitation, infection by computer virus,
bugs, tampering, unauthorized intervention, fraud, technical
failures, or any other causes which corrupt or affect the
administration, security, fairness, integrity or proper conduct of
the Challenge, the Challenge Sponsor reserves the right, at its
sole discretion, to cancel, modify or terminate the Challenge.
Further, the Challenge Sponsor reserves the right, at its sole
discretion, to disqualify any individual deemed to be (a) tampering
or attempting to tamper with the entry process or the operation of
the Challenge or the Challenge Sponsor or the ExchangesConnect
social networking site hosted on Ning; (b) violating the Challenge
Rules; (c) violating the Ning Terms of Service, (d) violating the
Challenge Sponsor’s Terms of Use and Privacy Statements, or (e)
acting in an unsportsmanlike or disruptive manner, or with intent
to annoy, abuse, threaten or harass any other person.
Limitations of Liability and Release
Challenge Sponsor and Challenge Parties assume no liability or
responsibility resulting from any user's participation in or
attempt to participate in the Challenge or ability or inability to
upload or download any information in connection with participating
in the Challenge. Challenge Sponsor and Challenge Parties assume no
responsibility or liability for technical problems or technical
malfunction arising in connection with any of the following
occurrences which may affect the operation of the Challenge:
hardware or software errors; faulty computer, telephone, cable,
satellite, network, electronic, wireless or Internet connectivity
or other online communication problems; errors or limitations of
any Internet service providers, servers, hosts or providers;
garbled, jumbled or faulty data transmissions; failure of any email
transmissions to be sent or received; lost, late, delayed or
intercepted email transmissions; inaccessibility of the
ExchangesConnect community social network in whole or in part for
any reason; traffic congestion on the Internet or the
ExchangesConnect social network or on the Ning platform; failure of
the Ning platform; unauthorized human or non-human intervention
with the operation of the Challenge, including without limitation,
unauthorized tampering, hacking, theft, virus, bugs, worms; or
destruction of any aspect of the Challenge, or loss, miscount,
misdirection, inaccessibility or unavailability of an email account
used in connection with the Challenge. Challenge Sponsor and
Challenge Parties are not responsible for any typographical errors
in the announcement of prizes or these Official Rules, or any
inaccurate or incorrect data contained on the ExchangesConnect
social network. Use of ExchangesConnect social network is at user's
own risk and is based upon user’s agreement with Ning’s Terms of
Service, Ning’s Privacy Statement, the ExchangesConnect Terms of
Use and the ExchangesConnect Privacy Statement. Challenge Sponsor
and the Challenge Parties are not responsible for any personal
injury or property damage or loss of any kind which may be
sustained to user’s or any other person's computer equipment
resulting from participation in the Challenge, use of the
ExchangesConnect social network or Ning, or the download of any
information from the ExchangesConnect social network by Ning. By
participating in the Challenge, the Entrant releases Challenge
Sponsor and any Challenge Parties from any and all claims, damages
or liabilities arising from or relating to such Entrant’s
participation in the Challenge. The Challenge Sponsor and Challenge
Parties are not liable in the event that any portion of the
Challenge is cancelled due to weather, fire, strike, acts of war or
terrorism, or any other condition beyond their control (a "Force
Majeure Event"). Should a Force Majeure Event occur, Challenge
Sponsor may, but is not obligated to, exercise reasonable efforts
to air the winning Entries and deliver all or part of the prizes or
make a reasonable substitution in its sole discretion.
